Know Your Rights: What Every Member Needs to Know

As a member of SEIU FPSU, you have rights in the workplace — and knowing them could make all the difference. Whether you are being called into a meeting with your supervisor or facing a potential disciplinary action, your union is here to protect you. Here is what every member needs to know.

If you are called into a meeting, remember this phrase:

“If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I respectfully request that my union representative be present.”

Say it clearly. Say it confidently. It is your right.

What are Weingarten Rights?

Weingarten Rights give union employees the right to have a union representative present during any investigatory interview or meeting that could lead to discipline. If your employer denies this request and continues the meeting, they are violating your rights under federal labor law.

These rights are grounded in Section 7 of the National Labor Relations Act, which protects employees’ right to self-organization, to form and join labor organizations, to bargain collectively through representatives of their own choosing, and to engage in other concerted activities for the purpose of collective bargaining or other mutual aid and protection.

When do Weingarten Rights apply?

  • When you are called into a meeting that could lead to discipline or termination
  • When your employer is conducting an investigatory interview about your conduct
  • When the outcome of the meeting could negatively affect your working conditions
  • When you reasonably believe the meeting may result in disciplinary action

What should you do?

  • Stay calm and professional
  • Clearly state your request to have your union representative present before the meeting begins
  • Do not waive your rights by agreeing to proceed without representation
  • Contact your steward immediately if your request is denied

Know your steward.

Your steward is your first line of defense in the workplace. They are trained to help you understand your rights, represent you in meetings, and file grievances when the contract is not being followed. Log in to the member portal to find your steward’s name and contact information so you always know who to call.
